Mom of 12-Year-Old Son With Cerebral Palsy Awarded $53 Million in Birth Injury Lawsuit

A jury has awarded $53 million to Lisa Ewing and her 12-year-old son, Isaiah, after filing a lawsuit in 2013 against the University of Chicago Medical Center where Isaiah was born with a serious brain injury.

The lawsuit alleged roughly 20 missteps by doctors and nurses upon Lisa’s arrival at the hospital at about 40 weeks pregnant and was experiencing little movement by her baby. These mistakes included but are not limited to: failure to carefully and properly monitor mother and baby, perform a timely cesarean section, and be aware of and monitor abnormal fetal heart rate patterns that indicated distress to the baby, including hypoxia (a drop in the supply of oxygen).

Isaiah has severe cerebral palsy, is in a wheelchair and needs his mother to feed, bathe, and clothe him. According to the Chicago Tribune, the jury’s award includes $28.8 million for future caretaking expenses and $7.2 million for future medical expenses. The jury’s verdict will help ensure Isaiah is taken care of for the rest of his life.
